1. Online Orders
1.1 Customers may purchase products through the Website
Customers may purchase products through the Website subject to product availability and acceptance of the order by ECG Gauging Services Ltd.
1.2 Accuracy of information and authority to use payment method
By placing an order through the Website, you confirm that the information provided by you is accurate and complete and that you have authority to use the payment method provided.
1.3 Order acknowledgement
After placing an order, you will receive an acknowledgement confirming that your order has been received. This acknowledgement does not necessarily constitute acceptance of the order.
1.4 Order acceptance
An order is accepted when ECG Gauging Services Ltd confirms acceptance of the order or dispatches the goods, whichever occurs first.
1.5 Right to refuse or cancel an order
ECG Gauging Services Ltd reserves the right to refuse or cancel an order where there is an obvious pricing or product information error, the product is unavailable, payment cannot be authorised, delivery cannot reasonably be completed, or where fraudulent or suspicious activity is suspected.
1.6 Cancellation after payment
If an order is cancelled after payment has been taken, the relevant payment will be refunded.
2. Product Availability
2.1 Product availability
All products displayed on the Website are subject to availability.
2.2 Unavailable products after ordering
Where a product becomes unavailable after an order has been placed, ECG Gauging Services Ltd will contact the customer and, where appropriate, offer an alternative product, revised delivery date or refund.
2.3 Product images, descriptions and specifications
Product images, descriptions and specifications are provided as accurately as reasonably possible. Manufacturers may make changes to product specifications, components, packaging or appearance without notice.
3. Prices and VAT
3.1 Prices in pounds sterling
All prices displayed on the Website are in pounds sterling (£).
3.2 VAT charges
Unless otherwise stated, applicable VAT will be charged at the prevailing rate.
3.3 Delivery and shipping charges
Delivery and shipping charges will be displayed separately where applicable and will be shown before the customer completes the order.
3.4 Flat-rate delivery charge
A flat-rate delivery charge of £15.00 applies to orders placed through the Website, unless otherwise stated at checkout or agreed separately in writing.
3.5 Pricing errors
ECG Gauging Services Ltd reserves the right to correct pricing errors. If a product has been listed at an obviously incorrect price, ECG Gauging Services Ltd may cancel the affected order and refund any payment already made.
4. Payment
4.1 Payment methods
Payment for online orders must be made using one of the payment methods made available during checkout.
4.2 Payment authorisation
Payment must be successfully authorised before an order can be processed and dispatched.
4.3 Fraud prevention checks
ECG Gauging Services Ltd may carry out reasonable checks to prevent fraud and protect customers and the business from unauthorised transactions.
5. Order Confirmation
5.1 Confirmation provided to customer
ECG Gauging Services Ltd will provide confirmation of the order using the contact details supplied by the customer.
5.2 Customer record keeping
Customers should retain their order confirmation and any related documentation for their records.
6. Delivery and Shipping
6.1 Delivery options and charges
Delivery options and applicable shipping charges will be displayed during checkout.
6.2 Delivery dates and times
Delivery dates and times shown on the Website are estimates unless a specific delivery date has been expressly agreed in writing.
6.3 Dispatch efforts
ECG Gauging Services Ltd will make reasonable efforts to dispatch orders within the stated timeframe.
6.4 Circumstances outside control
Delivery may be affected by circumstances outside our reasonable control, including courier delays, manufacturer delays, supply chain disruption, adverse weather, industrial action, customs delays or other unforeseen circumstances.
6.5 Significant delays
Where a significant delay occurs, we will contact the customer where reasonably practicable.
6.6 Customer responsibility for delivery information
Customers are responsible for ensuring that the delivery address and contact information supplied during checkout are accurate.
6.7 Incorrect or incomplete delivery address
Where a customer provides an incorrect or incomplete delivery address and this results in additional delivery or redelivery costs, those costs may be charged to the customer where legally permitted.
7. Delivery Damage or Incorrect Goods
7.1 Inspection of goods
Customers should inspect goods as soon as reasonably practicable following delivery.
7.2 Reporting damage or incorrect goods
If goods arrive visibly damaged, incorrect or incomplete, customers should contact ECG Gauging Services Ltd as soon as possible and provide details of the issue. Photographs may be requested to assist with investigating damage occurring during transit.
7.3 Prompt reporting
Reporting an issue promptly helps us resolve delivery problems quickly but does not affect any statutory rights available to consumers.
8. Returns (14 Days)
8.1 14-day return period
ECG Gauging Services Ltd offers a return period of 14 days from the date of receipt of goods, during which the customer may return eligible goods without providing a reason, subject to the exclusions set out at clause 10 below.
8.2 How to exercise this right
To exercise this right, the customer must clearly notify ECG Gauging Services Ltd of their decision to return the goods, by contacting info@ecggauging.co.uk.
8.3 Business customer restocking fee
Business customers: returns made under this 14-day period will be subject to a restocking fee of between 5% and 30% of the order value. As ECG Gauging Services Ltd sources many products to order rather than holding stock, the exact fee will depend on the terms applied by the relevant supplier for that item and will be confirmed to the customer before the return is accepted. Business customers should contact ECG Gauging Services Ltd before returning any goods so the applicable fee and return arrangements can be confirmed.
8.4 Consumer returns
Consumers: no restocking fee applies to a valid cancellation made by a consumer within the 14-day period. Consumer statutory cancellation rights, set out at clause 9 below, apply in addition to this clause.
9. Consumer Cancellation Rights
9.1 Statutory cancellation right
Where an online purchase is made by a consumer, the consumer may have a statutory right to cancel the order within 14 days of receiving the goods, without providing a reason.
9.2 How to cancel
To exercise this right, the consumer must clearly notify ECG Gauging Services Ltd of their decision to cancel, by contacting info@ecggauging.co.uk.
9.3 Refunds under consumer law
Where a consumer validly exercises their cancellation rights, ECG Gauging Services Ltd will provide the applicable refund in accordance with UK consumer law.
9.4 Refund of delivery charges
The standard delivery charge paid by the consumer will normally be refunded where required by law. Where the consumer selected a more expensive delivery option than the least expensive standard delivery option offered by ECG Gauging Services Ltd, the additional cost may not be refundable where permitted by law.
10. Products Excluded from Cancellation
10.1 Excluded product types
Certain products may be excluded from the statutory cancellation right and the 14-day return right at clause 8. This may include products that are: (i) made to the customer's specifications; (ii) personalised; (iii) bespoke or custom manufactured; (iv) configured specifically for the customer; (v) imported or specially sourced from outside the UK; or (vi) otherwise subject to an applicable statutory exception.
10.2 Notification of excluded products
Where an order is for a bespoke, personalised, custom or specially imported product, ECG Gauging Services Ltd will advise the customer where the cancellation right does not apply.
10.3 Statutory rights unaffected
This does not affect any statutory rights relating to faulty, defective, incorrectly supplied or misdescribed goods.
11. Returning Goods
11.1 Return period for consumers
Where a consumer exercises a valid cancellation right, goods must be returned within the applicable statutory period.
11.2 Return costs
Unless the goods are faulty, damaged or incorrectly supplied, the customer may be responsible for the direct cost of returning the goods where this has been communicated before the order was placed.
11.3 Packaging of returned goods
Goods should be returned appropriately packaged to prevent damage during transportation.
11.4 Reduction in value
Where permitted by law, ECG Gauging Services Ltd may take account of any reduction in the value of goods resulting from handling beyond what is reasonably necessary to establish their nature, characteristics and functioning.
12. Incorrectly Ordered Items
12.1 Customer responsibility
The customer is responsible for checking that the product ordered, including its specification, range, model and configuration, is correct and suitable for their intended purpose before placing an order.
12.2 Handling incorrect orders
Where an item has been incorrectly ordered by the customer, any return will be handled in accordance with clause 8 (Returns) above and, in the case of business customers, will be subject to the restocking fee set out at clause 8.3.
12.3 Statutory rights unaffected
This clause does not affect any statutory rights relating to faulty, defective, incorrectly supplied or misdescribed goods.
13. Warranty and Faulty or Defective Goods
13.1 12-month warranty
Products purchased through the Website carry a 12-month warranty from the date of delivery, as set out in ECG Gauging Services Ltd's Terms and Conditions of Sale. Any defect in materials or workmanship reported within this period will be repaired or replaced at no cost to the customer, in accordance with those Terms and Conditions of Sale.
13.2 Statutory rights
Nothing in these Terms affects a consumer's statutory rights.
13.3 Reporting faulty or defective goods
If goods are faulty, defective, damaged, incorrectly supplied or do not conform to the contract, customers should contact ECG Gauging Services Ltd as soon as reasonably practicable.
13.4 Customer remedies
Depending on the circumstances and applicable law, the customer may be entitled to a repair, replacement, price reduction or refund.
13.5 Manufacturer and company warranties
Any manufacturer's warranty or ECG Gauging Services Ltd warranty applies in addition to, and does not replace, statutory consumer rights.
14. Business Customers
14.1 Consumer rights do not normally apply
Where goods are purchased by a business or other organisation acting in the course of business, consumer cancellation rights do not normally apply, and the 14-day Returns terms at clause 8 (including the applicable restocking fee) apply instead.
14.2 Contact before returning goods
Business customers should contact ECG Gauging Services Ltd before returning any goods.
14.3 Additional charges
Returns by business customers may be subject to the existing Terms and Conditions of Sale, including any applicable restocking, administration, delivery or other charges agreed between the parties.
15. Refunds
15.1 Refund method
Where a refund is due, ECG Gauging Services Ltd will normally refund the payment using the same payment method originally used by the customer, unless otherwise agreed.
15.2 Refund timeframe
Refunds will be made within the period required by applicable law.
15.3 Evidence of return
Where goods are being returned, ECG Gauging Services Ltd may wait until the goods have been returned or the customer provides reasonable evidence that they have been returned, where permitted by law.
16. Limitation of Liability
16.1 No liability for indirect damages
In no event shall ECG Gauging Services Ltd be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use or performance of its products or services purchased through the Website.
16.2 Liability cap
ECG Gauging Services Ltd's total liability under these Terms shall not exceed the purchase price paid by the customer for the products or services giving rise to the liability.
16.3 Non-excludable liability
Nothing in these Terms excludes or limits ECG Gauging Services Ltd's liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability which cannot be excluded or limited as a matter of law, and nothing in this clause affects a consumer's statutory rights.
17. Security and Payment Information
17.1 Third-party payment processors
Online payments may be processed by third-party payment service providers.
17.2 Storage of payment card details
ECG Gauging Services Ltd does not intend to store complete payment card details on its own servers where payment processing is handled by an external payment provider.
17.3 Payment provider terms
Customers should refer to the relevant payment provider's terms and privacy information for further information about payment processing.
17.4 Protection of customer information
ECG Gauging Services Ltd uses appropriate technical and organisational measures to protect customer information submitted through the Website.
18. Order of Precedence
18.1 Relationship with other policies
These Terms apply specifically to orders placed through the Website and should be read together with ECG Gauging Services Ltd's Terms and Conditions of Sale and Privacy Policy.
18.2 Precedence in case of conflict
In the event of any conflict or inconsistency between these Terms and ECG Gauging Services Ltd's Terms and Conditions of Sale in relation to an order placed through the Website, these Terms shall take precedence to the extent of that conflict.
19. Statutory Rights
19.1 Non-excludable rights
Nothing in these Terms is intended to exclude, restrict or otherwise limit any rights or remedies that cannot legally be excluded or limited.
19.2 Consumer statutory rights
Where the customer is a consumer, their statutory rights under applicable UK consumer law apply in addition to these Terms.
